About Surplus Funds Recovery Fees
When a property is sold at a tax sale or mortgage foreclosure for more than the amount owed, the excess funds — called surplus funds or excess proceeds — are held by the county or court for the former owner or their heirs.
Recovery agents charge a percentage fee (typically 25–45%) to locate claimants, prepare documents, and file on their behalf. This calculator helps you estimate how much you'd actually receive after those fees.
Some states cap the maximum fee a recovery agent can charge. For example, California limits fees to 50% for tax sale surpluses under §4675 of the Revenue and Taxation Code. Always check your state's statutes before signing an agreement.
